一、 出租人: (以下简称“甲方”)

Upon expiry of this lease, Party A has the right to take back the entire Premises , and Party B shall return the Premises on or prior to the date of expiry in the same condition as it is delivered or the other condition the parties agree to Party B by Party A .

租期届满,乙方如要求续租,应在本合同期限届满前两个月提出书面申请,取得甲方同意后,甲、乙双方须另行签署租赁协议。

If Party B wishes to renew the lease, party B shall submit a written application to Party A two months prior to the expiry of this lease, and a lease agreement shall be concluded between the parties separately subject to Party A‘s consent.

五、 免租期(含装修期)

七、支付方式:

Payment:

八、币种和帐户:

乙方应按甲方指定的帐户支付本合同项下所有的到期款项,所有付款以人民币计算,以人民币支付。

Party B shall pay the rent and all other amounts due and payable in RMB to the account designated by Party A.

九、保证金:

Deposit:

Within【 】days after the execution of this Lease Agreement, Party B shall pay to Party A a deposit in the amount of【 】-month rent and the first rent RMB【 】 , totaling RMB【 】。

本合同期满,如本合同不续租,甲方应在期满后三十(三零)天内返还保证金(不计利息)如乙方因违约而导致违约金、赔偿金、费用和/或乙方尚未支付任何应付款项,甲方可从保证金中扣除此类违约金、赔偿金、费用和/或未付款项。

Upon expiration of the Lease Agreement, if the Lease Agreement is not to be renewed, Party A shall refund the deposit without interest to Party B within thirty (三零) days after the expiration of this Lease Agreement. If there is any default penalty or compensation or expenses incurred due to the breach of Party B and/or any due amount that Party B fails to pay, Party A may deduct such default penalty or compensation or expenses or due amount from the deposit.

在本合同期限内,如有任何应由乙方支付的违约金、赔偿金、费用和/或其他应付款项,甲方可直接从保证金中予以扣除,乙方应在接到甲方书面通知后五(五)天内补足该部分保证金。

During the lease term, if there is any default penalty, compensation or expense and/or any other due amount that shall be paid by Party B, Party A may deduct such amount from the deposit and Party B shall, within five (五) days after Party A so notifies.

十、大厦及承租区域的交付状态:

The state of the Premises when delivery :

甲方按现状交楼,具备办公条件。

Party A will deliver the Premises at as-it-is basis, which satisfies the conditions as office.

十一、甲方的权利义务:

Party A‘S RIGHTS AND RESPONSIBILITES:

甲方在本租赁合同规定的期限内将房屋交付乙方。

Party A shall deliver the Premises to Party B within the term specified herein.

甲方保证是房屋的合法权利人,有充分的权利出租房屋。

Party A shall ensure that it is legal owner of the Premises and have full right to lease the Premises.

甲方的权利保留Party A may reserve the following rights.

使用公共设施;to use the public facilities;

进入房屋内对公共设施进行检查和维修。甲方行使该项权利时,应提前通知乙方,紧急情况除外。

to enter into the Premises for check and maintenance provided that Party A shall inform Party B in advance except under emergency.

在发出通知后(紧急情况除外),有权暂停大厦设施进行维修和维护,可能导致水电的中断。甲方无需为此承担责任。

To repair and maintain the facilities of the building which may result in the suspension of water and electricity, upon a notice (except under emergency) without any liability thereof.

甲方应协助提供乙方提供办理工商营业执照所需相关证明文件。

Party A shall assist Party B in registering with industrial and commercial administration by provide necessary documents.

甲方在承租期内促使物业管理机构提供水、电、空调、供暖及日常房屋维修。

Party A shall procure the Management Department to provide water, electricity, air conditioning, heating and daily maintenance during the lease period.

如在租赁期届满前两个月,乙方未提出续租请求,或者虽然提出续租请求,但双方在三十天内未就续租合同条款达成一致,甲方有权在工作时间带领其他租户进入房屋查看。

If Party B does not submit an application for renewal two months prior to the expiration of this Lease Agreement, or if Party B submits such application but the parties fail to reach agreement on the renewal, Party A shall have the right to enter the Premises with other tenant at work hours to review.

十二、乙方的权利和义务

Party B‘S RIGHTS AND RESPONSIBILITES:

自行负责房屋的装修和设施。

Party B shall be responsible for the decoration and facilities of the Premises.

除非经消防局及甲方同意,乙方不得对房屋的主要结构及装置(包括烟感器及喷淋头)作任何变动、拆除或调整。如乙方擅自做任何变动,应负责将其恢复原状并承担一切费用和相关责任。

Party B shall not alter, change, dismantle or adjust the main structure or facilities including the smoke sensor and spray without the consents of Party A and fire control authority. If Party B makes any alteration, dismantle or adjustment as aforesaid, it shall be responsible for restoration and bear all expenses and related liabilities.

乙方应根据本合同第六、七、八条的规定按时缴纳租金及各项相关费用。

Party B shall pay the rent and other fees pursuant to Clauses 六, 七, and 八 on time.

乙方应按本合同的规定合理使用房屋,并保持房屋的清洁。

Party B shall reasonably use the Premises as provided hereunder and keep it clean.

未得到甲方及大厦管理机构的事先同意,乙方不得在窗外、外墙、

公共走廊墙面、电梯间及其它共用区域悬挂、张贴、附置或以其它方式放置任何广告、标识、招贴或其它资料。

Party B shall not hang, affix, or display any advertisement, signboard, poster or any other materials on outside window, outside wall, public aisle wall, elevator or other public area without the prior consents of Party A and Management Department.

乙方在承租期内不得将全部或部分房屋转租、分租或借予第三方。

During the lease term , Party B shall not sub-let or assign the lease to any third party.

乙方在其经营活动中,不得宣称或令顾客误认为其与甲方关系属合作、合营、合伙、联营或关联企业关系。

Party B shall not represent or otherwise mislead the customers that it has any cooperation, joint operation, partnership or affiliation relation with Party A during its operation.

乙方应自行获取依据法律法规和政府有关部门规定应具备的所有许可、批准和证照,保证其营业活动的合法性。

Party B shall be responsible for obtaining all approvals, consents and licenses required by laws to ensure that its operation is legal.

乙方应自行承担由于乙方工商注册、税务登记、迁址等行为所产生的税、费。

Party B shall be responsible for any and all taxes, fees and expenses incurred for its industrial and taxation registrations and moving into the Premises.

对于第三方因乙方对其造成或在房屋内发生的人身伤害或经济损失而提出的索赔,乙方应自行负责并保证甲方免于此类索赔。如甲方因此类索赔而遭受损失,乙方保证进行赔偿。

Party B shall be responsible for and hold Party A harmless against any claims raised by the customers for any personal injury and economic losses caused to the customers by Party B or caused in the Premises. Party B hereby warranties that it shall indemnity Party A for any losses caused to Party A by such claims.

乙方不得在房屋内放置易燃、易爆的物品其他危险物品。

Party B shall not keep or store in the Premises any flammable or explosive substances or other dangerous substances.

乙方应严格遵守甲方和/或大厦物业管理机构制定并不时修改的大厦所有管理规定。

Party B shall strictly comply with all rules made and amended from time to time by Party and/or the Management Department.

乙方不得在房屋内从事任何违法活动。

Party B shall not carry out any illegal activity in the Premises.

乙方不得将房屋用于除办公以外的用途。

Party B shall not use the Premises for any purpose other than as office.

若乙方以租赁房屋作为其公司注册地址时,乙方应在租赁合同终止后一五日内办理地址注销登记手续,乙方逾期办理的,应每日按月租金千分之三的标准向甲方支付滞纳金,造成甲方损失的,应予以赔偿。

If the Premises is used as company‘s registered address of Party B, Party B shall complete the procedures of writing off the registered address within 一五 days after termination of the contract. If Party B is not able to complete the procedures on time , it shall pay Party A a penalty equal to 三‰ of the monthly rent per day of delay. Party B shall compensate for such loss.

十三、违约责任与合同终止

BREACH AND TERMINATION

任何一方违反合同给另一方造成损失的,应当进行赔偿。

If a party is in breach of this Lease Agreement, it shall compensate the other party for any losses cause by its breach.

在下列任何情况下,本合同终止

This Lease Agreement will be terminated under any of the following conditions:

租赁期限届满:

The expiration of this Lease Agreement

当一方违反本合同中任何规定,并且另一方书面通知要求其予以纠正的三十(三零)日内未能纠正违约行为或者如果该违约是无法纠正的,守约方有权立即终止本合同。

by one of the Parties, with immediate effect, when the other Party is in breach of this Lease Agreement and such breach is not curable or is not remedied within thirty (三零) days after the party not in breach sends a written notice requesting the cure of such breach;

甲方可以提前六十(六零)天的书面通知提前终止本合同,但应双倍返还乙方保证金。

Party A may terminate this Lease Agreement with a sixty (六零) day prior written notice provided that it shall refund the deposit in double amount.

如乙方延期支付租金和/或其他各项款项超过十(一零)日,甲方有权解除合同,保证金不予退还。乙方除应支付延期款项外,还应支付逾期付款违约金,数额延期支付金额的日,直至乙方全额付清为止。

If Party B delays the payment of rent and/or other amounts for ten (一零) days, Party A shall have the right to terminate this Lease Agreement and the deposit shall not be refunded. Party B shall pay a default penalty for the overdue amount at the rate of of the overdue amount per day until it pays in full amount, in addition to pay all the overdue amounts.

如乙方不遵守大厦管理规定并严重影响其他租户正常经营,甲方可以书面通知乙方提前终止本合同,并且保证金不予返还。

If Party B does not comply with the management rules of the building and therefore seriously affects the normal operation of other tenants, Party A may terminate this Lease Agreement in advance with a written notice and the deposit shall not be refunded.

如乙方在房屋内从事任何违法活动或未按照办公用途使用房屋,甲方有权立即书面通知乙方提前终止本合同,保证金不予返还。

If Party B carries out any illegal activity in the Premises or use the Premises for other purpose than office, Party A shall have the right to immediately terminate this Lease Agreement with a written notice and the deposit shall not be refunded.

如乙方将房屋分租或转租第三方,甲方有权以书面通知立即终止合同,并且保证金不返还。

If Party B sublets or assigns the lease to a third party, Party A shall have the right to immediately terminate this Lease Agreement with a written notice and the deposit shall not be refunded.

不可抗力Force Majeure

一方因不可抗力事件连续六十天(六零)不能履行义务,任何一方可以书面通知终止本合同,在不可抗力的影响范围内受影响的一方不承担违约责任。“不可抗力”包括自然灾害、爆炸、飞行物体坠落、政府行为(但专门针对受影响一方的行政行为除外)等受影响的一方不能预见、不能控制并且不可避免的事件。双方在此明确但商业性风险不应作为不可抗力。受影响的一方应在不可抗力事件发生后的五(五)日内书面通知对方,并且应附有有权机构出具的不可抗力发生的证明。

Eith

er Party may terminate this Lease Agreement with a written notice if one party is not able to perform its obligations hereunder for consecutive sixty (六零) days due to force majeure. The affected party shall not bear the liability of breach of contract to the extent of the effect of the force majeure. Force Majeure shall include such events that the affected party is not able to foresee, control and avoid as natural disaster, explosive, falling of flying objects, government action (except those specially against the affected party) The parties hereby confirm that commercial risk shall not be deemed force majeure. The affected party shall notify the other party in writing of such force majeure event accompanying with the certification of the occurrence of the force majeure event issued by competent authority.

一方进入破产、清算、解散或任何类似程序,另一方可以终止本合同,但以善意管理费用或合并为目的的除外。

One party may terminate this Lease Agreement if the other party launches the bankruptcy, liquidation, winding up or any similar procedure other than for the purpose of a bona fide reconstruction or amalgamation.

一三. 三 合同终止的后果 The result of the termination

如本合同届满并且未由乙方续租,乙方须于届满之日的一七点之前腾空房屋;如本合同因任何原因提前终止,乙方应于终止日后的三日内腾空房屋。如乙方未能在此期间腾空房屋,由乙方应按日支付房租,逾期十日以上(包括十日),乙方应按双倍房租支付。如因此给甲方造成经济损失(包括因未能向下一租户及时交付房屋而导致的违约金和租金收入),还应赔偿损失。

If this Lease Agreement is expired without the renewal of Party B, Party B shall vacant the Premises by 五pm on the date of expiration; if this Lease Agreement is terminated in advance for whatever reason, Party B shall vacant the Premises within three (三) days after the termination date. If Party B fails to vacant the Premises within the aforesaid period, it shall pay rent for each day of delay. If the delay is over ten (一零) day (inclusive), Party B shall pay the rent in double amount. If there is any economic loss caused to Party A including the penalty for not delivering the Premises to next tenant on time and rent loss, Party B shall compensate such loss.

乙方还应拆除装修和清理房屋(甲方同意保留装修的除外),以甲方交付之时的状态或双方共同认可的状态将房屋交还甲方(正常损耗除外)归还房屋时留在房屋内的所有设施、装修及物品均视为乙方放弃所有权,甲方可随意处置。如乙方未将房屋恢复原状,甲方可自行恢复原状,乙方需支付全部费用,可由甲方从保证金中扣除。

Party B shall also dismantle the decoration (Except for the decoration that Party A agrees to retain)and clean the Premises so that the Premises will be returned to Party A in the same condition as when delivered to Party B or (fair tear and wear is excepted) Party B shall be deemed waiving the title of all facilities, decoration and staff left the Premises when the Premises is returned to Party A and Party A may dispose them in any way. If Party B fails to restore the Premises to the condition of delivery, Party A may restore the Premises to the condition of delivery and Party B shall bear all expenses thereof, which may be deducted from the deposit by Party A.

除因乙方违约造成合同终止的情况以及本合同有不同规定的情况以外,甲方应将保证金返还乙方。

Party A shall refund the deposit to Party B except the termination is caused by the breach of Party B and otherwise provided hereunder.

乙方应支付全部应付费用,包括房租、水电费、电话费等。

Party B shall pay in full amount all the due payment including rent, water and electricity fee and telephone call charge.

双方应按下列程序进行交接房屋。

The parties shall take over the Premises in accordance with the following procedure.

十四、附则

争议的解决 Dispute Resolution

因执行本合同或与本合同有关的一切争议,双方应通过友好协商解决。协商不成的,则任何一方有权将争议提交北京仲裁委员会仲裁裁决。仲裁程序应遵照仲裁委员会的现行仲裁规则进行。仲裁期间,双方应继续执行本合同不涉及争议的部分。

Any disputes arising from the execution of or in connection with

this Lease Agreement shall be settled through friendly consultations between the parties. In case no settlement can be reached through consultations, such dispute shall be submitted to Beijing Arbitration Committee in accordance with its Rules. During the arbitration, the Parties shall continue to perform the part of this Lease Agreement not under dispute.

合同的修改The amendment of this Lease Agreement

对本合同只可通过双方书面修改。

This Lease Agreement may be changed only by a written instrument signed by parties.

可分性 Severability

本合同任何条款无效,不影响其他条款的效力。

The invalidity of any part of this Lease Agreement shall not affect the validity of other clauses.

全部协议 Entire Agreement

本合同有其附件构成双方之间就本合同所涉事项达成的全部协议,取代双方此前就合同事项达成的所有口头和书面协议。

通知 Notice

任何一方根据本合同发出的通知或其他联系应以中文书写并应通过专人送递或挂号邮寄或以公认的快递服务或以传真(应当有发送成功的报告)发送至另一方的下述地址。通知视为有效送达的日期按以下方法予以确定:

一.引言

师范英语本科生是未来的英语教师,也有文献称之为“职前教师”(pre-service teacher),师范院校的外语院系承担着培养未来英语教师的重要任务。随着中学英语新课程的深入实施,师范英语本科生的专业素质和培养方式逐渐受到英语学界及社会各界的关注,师范英语院系应该严肃审视和改进师范英语教育中存在的问题。在新的形势下,师范院系的英语教育应该如何实施,师范英语本科生应该具备怎样的专业素质才能适应社会需求,是一个不可回避的现实问题。

二.新形势下师范英语本科生专业素质的内涵

师范英语本科生应该具备什么样的专业素质,这一问题在不同时期有不同的答案,其专业素质要求必然随着时代的发展和社会的需求不断提高。在我国传统英语教学阶段(一九七八-一九九零),英语作为主要课程在中学阶段普遍开设,中学英语教师的需求量很大,而对其专业素质要求相应降低,只要求教师具备一定的语音、语法和英语词汇量。这一阶段所运用的教学方法,基本定格为语法翻译法和听说法,对教师的英语口语表达和语言运用能力没有明确要求,因为当时的社会仅需要具有一定读写能力的英语人才。随着国际交往的日益频繁,英语综合运用能力尤其是听说能力变得越来越重要,对英语教师的专业素质提出更高的要求。在二一世纪,社会要求英语毕业生是既懂语言又懂专业的复合型人才。由于师范英语教育是英语和教育的复合型专业,在师范英语本科生成为正式英语教师之前,他们应该具备的专业素养涉及英语语言和教育两个大的方面。

师范英语本科生专业素质是指师范英语本科生为以后从事英语教育工作所必须具备的各种专业能力的总称。田式国(二零零零)认为,外语教师应具备政治思想和人格心理素质、现代教育理论和外语教育学理论及其他相关理论素养、科学文化素养、学科知识和语言运用能力、教学技能和教学方法、学习能力和教育科研能力等六个方面[一]。张正东、李少伶(二零零三)提出,在职英语教师的发展包括英语教学信念、教育专业精神、英语专业知识和技能和教育技能四个方面的发展[二]。笔者认为,师范英语本科生是未来的英语教师,其英语专业素质必须涵盖以下三个方面,并有所侧重。

英语教学理念和师德。

英语教学理念即对英语教育教学所持有的观念,包括对英语学习者特征和学习性质的观念、英语教学特点和英语学科价值的观念等。英语教学理念直接影响和制约英语教师的教学行为,一旦形成,就很难改变。

师德即为人师表,为学生树立人格楷模。教师必须拥有健康的个性心理,良好的职业道德和积极的情感态度。这些直接影响学生的学习和身心成长。教学理念和师德属于意识层面的内容,可以通过相关课程的学习和熏陶而形成。师范英语本科生通过四年的师范教育,应该对教师这一职业有一定的理性认识,形成热爱教育,关爱学生,成为学生表率的思想情怀。

与英语教学相关的知识与技能。

与英语教学相关的知识,包括从事英语教学所需要的百科知识,英语语言和文化知识,英语语言理论和英语教育教学理论等知识;与英语教学相关的语言技能,是指综合运用语言的能力和运用英语进行课堂教学的能力。首先,师范英语本科生应该具有广博的知识,对社会生活的各个方面如时政、历史地理、文化习俗、科普等有所了解。其次,要具有丰富的英语语言知识,如正确的语音、语法知识和跨文化知识,掌握基本的英语语言理论知识如普通语言学、应用语言学、语用学和语言习得理论,把握对英语教学产生主要影响的心理学和教育学等基本原理、英语教学流派和方法,了解学习者的心理特征和学习风格。再次,必须具备扎实的语言基本技能,包括英语和汉语基本技能。良好的英语综合运用能力,特别是听说能力可为学生提供正确的语言输入,有利于创设语言使用的情境。良好的汉语功底和表达能力有助于中西文化对比,帮助学生更好地了解和掌握目的语言。师范英语本科生在校学习期间,应该在英语专业知识与技能方面打下坚实的基础。

包括课堂教学组织能力,教材处理能力,灵活运用教学方法和手段的能力,协调师生关系的能力,以及改进课堂教学的反思和行动研究能力。在知识海量增加、信息传递快速的当今时代,具有鉴别、筛选和整合利用网络英语课程资源的能力,是必不可少的。

对于师范英语本科生来说,由于真实课堂实践的不足,英语教育技能方面可能相对薄弱,但通过课堂学习、见习和实习等环节的训练,应该具备初步的教育技能。

三.师范英语本科生专业素质培养中存在的问题

师范英语本科生的培养缺乏具体明确的目标。

师范英语专业是英语专业的一个方向。长期以来,师范英语教育和英语类其他专业方向共同接受教育部《高等学校英语专业英语教学大纲》(以下简称《大纲》)的指导。《大纲》规定:“高等学校英语专业培养具有扎实的英语语言基础和广博的文化知识并能熟练地运用英语在外事、教育、经贸、文化、科技、军事等部门从事翻译、教学、管理、研究等工作的复合型英语人才。”[三]这是一个英语专业的纲领性文件,对于规范所有英语专业的设置无疑是科学的。但是,各校必须根据自身的条件和办学实际,制定自己的培养目标,以体现自己的专业特色[四]。

现有课程设置存在弊端。

由于种种原因,课程设置中存在语言技能课程分得过细、师范教育课程通才化设置、教学实践有待加强等问题,

师范英语语言技能课程分得过细

在语言技能课程设置方面,低年级除了开设专门的语音、语法课之外,英语听说读写还分成听力、口语、阅读和写作四门课程,其中听力、口语、阅读持续四个学期的教学。有的学校还同时或先后开设英语视听说课。笔者认为,这样将听说读写人为分割,不符合语言使用的实际。

在课堂活动或现实生活中,一个任务的完成需要多种语言技能的综合运用[五]二二。同样,有人说话就有人听,除非自言自语,听和说多半相辅相成,这就要求语言教学也必须遵循这一事实。布罗斯纳等人(Brosnan et al)指出,成人(学习者)要能看出他们在课堂上所做的和课外需要做的之间的直接联系[五]五八。其意即,课堂语言教学要和课堂外的语言使用相关联。任何一门语言都是人文性和实践性的统一。如果课堂教学和课外运用脱节,势必影响学生语言运用能力的发展。王初明(二零零六)认为:“在现实生活中,单独听的情况是不多的,要么视听,要么听说,要么视听说同时进行。听总是发生在一定的语境里,如此方能体现语言的交际功能。”[六]事实上,英语听力教学都是在语音室进行的,学生戴着耳机输入的都是纯音频信息,听完后完成听力理解题。“对着不会提供反馈的机器,听者不得不依靠大脑中的内部语境帮助理解,若相关的外语语境知识欠缺,不仅听懂困难,而且容易感到厌倦疲劳,致使学习兴趣下降”[六]。这样的听力训练不但交际语境缺失,而且训练方式和客观实际的语言使用相差甚远。

写的问题,除了书信、邀请等之类的应用文写作,大多数情况下,听、读和写也是相互联系的。人们往往在听到或阅读到某一现象、内容之后,有感而发,产生写作的冲动,或针砭时弊,或抒发心中的感受,抑或文学批评,等等。如果在学生阅读语篇信息、掌握阅读技巧的同时,结合阅读内容进行写作练习,学生会觉得有内容可写,写作兴趣会得到激发。

师范英语教育课程通才化设置

根据英语专业教学大纲,师范英语方向的学生在大学四年的时间内,要求学习的专业课程主要有:专业基础课程,包括英语阅读、综合英语、听力、语音、口语、语法、写作、翻译等;英语专业必选课,包括语言学、英国文学、美国文学、高级英语、英美概况、跨文化交际、英美报刊阅读、教学法、第二外语等;专业选修课,包括英语词汇学、英语修辞学、高级翻译(笔译和口译)、高级听力、文学批评赏析、文学导论、英美文学名篇赏析等。有的院系师范英语教育增加了教育学基础、教育心理学等必选课及青少年心理学、英语教材设计与分析、英语测试等选修课[七]。大多数师范院系只开设英语教学法和教育学基础课程,另加一个学期的教育实习。由此可以看出,师范生不但要学习英语语言文学专业的课程,还要学习师范英语教育课程。这对于那些毕业后从事教师职业的学生,不但增加了课业负担,而且所开设的师范教育课程远远满足不了他们的需求。

教学实践有待加强。

教育实践包括讲课练习、见习和实习等环节。由于教育类课程所占的比例偏少,教学法课程的课时不足,学生在大学课堂登台练习的机会相对较少。

见习和实习是学生体验真实课堂的很好机会,学生能够通过教育见习和实习,加深对教师这一职业的了解,同时实习经历也会影响学生对是否从事教师工作的选择。有的高校由于师范生人数多,教学实习基地不足,只能联系一些教学条件差、学生基础和师资力量都很薄弱的中小学校,安排学生去实习。由于“中学指导教师自身不具备先进的教学理念,难以帮助实习生巩固理论学习的成效。而实习中出现的问题也没有得到其大学指导教师的关注,导致学生得出‘学的跟用的不一样’的判断”[七]。不愉快的实习经历会使学生产生对教学工作的厌恶和恐惧,形成对教师职业的消极心理。

四.培养师范英语本科生专业素质的建议

制定师范英语教育培养目标。

师范英语教育培养的是英语+教育学+心理学+教育技能的复合型人才。显然,师范英语专业应该有自己的教学大纲。因为缺乏本方向的教学大纲,师范英语教育就没有明确的定位,游离于英语语言文学和英语教育之间,“限于课时及师生的传统观念,相关专业知识课程边缘化”[八]。而培养通用人才仍然是师范院校的主要目标[九]。因此,师范英语教育的地位难以彰显,师范英语教育的特色不够突出。同时,师范英语类学生的英语语言文学基础也不同程度地被削弱。用学生自己的话说就是:“什么都要学,什么都学得不精通。”

师范英语教育是师范院校的特色,要旗帜鲜明地突出师范英语教育的特色,培养符合社会需求的英语教育人才,师范院校必须在教育目标、课程设置、评价等方面制定具体、可测量的标准。

改革已有语言技能课程设置,增加内容教学。

Anderson and Lynch(一九八八,参见Nunan _)[五]二三-二七将听力理解区分为交互性的听和非交互性的听。交互性的听指听者有机会和说话者进行交互,非交互性的听指单向的信息传递,听广播或演讲等。对于交互性的听,最好和口语包括对话与独白相结合。Brown and Yule(一九八三,参见Nunan _)[五]二三-二七指出,正常人都具有口语交际能力,但是独白的能力需要专门的学习和训练。在教学中,训练简单的日常会话能力是不够的,还要训练学生就某一现象或事物用一段长而连贯的独白发表自己的观点。

听和读属于语言输入,而说和写属于语言输出。根据输入和输出假设,输入是基础和前提,输出是目的。只有输入没有输出,输入的语言信息就难以内化,学生学到的将是一堆僵死的知识;仅有输出没有输入,输出将成无源之水,无本之木。只有做到输入和输出有机结合,才会达到理想的语言学习效果。

由此,对于语言技能类课程,不妨将听力和口语合并,开设英语(视)听说;将阅读和写作合并,开设英语读写,在阅读材料中增加经典文学名著选段、政治、历史、文化、经济及学术等内容的教学;单独开设语音和语法课,并增加课时,而且要加强这两门课程的教学,保证每一个师范生都过好语音和语法关。

加强实践环节教学。

前面提到的教育教学课程的边缘化,源于学校、教师、学生对该课程不够重视,使得实践环节的教学难以取得实效。加上相当一部分师范英语专业学生不打算从事教师职业,英语教学课程成了这部分学生的负担和包袱,课堂上“甲课做乙事”的现象屡见不鲜。笔者认为,让所有学生都上英语教育类课程,统一参加英语教育实习,但其中又有部分学生不愿意从事教育工作,这是对英语教育资源的浪费。管理者应该采取区别措施(如只有明确了毕业后要从事教师职业的学生才选择上英语教学课程,否则,他可以选择其他课程),保证那些立志从事教师职业的学生能有充分的学习和锻炼机会。在此基础上,再加强实践环节的教学。首先,应该增加英语教学课程的课时,这样才有时间给大多数学生课堂教学练习的机会。其次,尽量创造条件让学生到教学基础好的学校见习和实习。教学条件和基础好的学校,教师的教学理念和教学方法相对先进,可以为实习生起到良好的示范作用,使他们强化在课堂所学到的先进理论知识。最后,大学指导教师要尽量多地和实习学生联系,了解学生的情况,时间允许的话,多去实习学校,实地指导。

一、租赁融资

Leased Premises

三、租金及保证金

Rental an d Deposit

乙方应予签署本合同后五日内向甲方支付相当于一个月租金的金额,即人民币

四、出租人的责任

Lan dlo rd's Responsibilities

甲方须按时将出租融资及家具电器(见附件一)以良好的状态交付给乙方使用。

Party A should deliver on schedule the leased property an d the furniture an d appliances (refer to Appendix I) in good condition to Party B.

甲方应确保或责成融资管理公司对融资及其公共设施进行定期维修保养,包括

但不限于融资内的空调、上下水管、电线电缆、煤气管道、通讯及有线电视等设施,使之处于正常的使用状态。

Party A should guarantee o r o rder the property management company to carry out maintenance an d repair of the said premises an d the facilities in good an d proper operation regularly, including but not restricted to air-conditions, water pipelines, wires an d cables, gas pipelines, communication an d cable TV etc.

房屋基本设施和结构损坏时(不包括乙方损坏的家具和器具),甲方必须在二四 小时内提供维修服务或给予乙方答复,并承担相关的费用。

In case of the basic facilities an d structure of the premises being damaged (not including furniture an d appliances damaged by Party B), Party A shall repair o r respond to Party B's complaints within 二四 hours, an d bear all costs related thereto.

甲方在此声明及保证甲方为出租房屋的合法拥有人并有合法地位出租此房屋给乙方。就本合同及出租此房屋于乙方之事,甲方已取得所有有关机构的批准,包括政府批准及抵押权人的同意。甲方于本合同所做出的声明与保证,如有错误或违反者,甲方须就因此而对乙方引起的任何损失、损害、支出及费用对乙方做出全额补偿。

Party A hereby represents an d warrants that Party A is the legal owner of the leased property an d has the necessary capacity to lease the property to Party B. Party A has also obtained all the necessary autho rizations from all relevant autho rities in respect of this Contract an d the leasing of the property to Party B, including government approval an d/o r mo rtgage consent. Party A shall be liable to keep Party B fully indemnI fied against any costs, expenses, losses an d damages incurred an d suffered by Party B as a result of any breach of Party A's representations o r warranties herein.

如在租赁期内,租赁房屋发生所有权全部或部分转移,和其它影响乙方权益的事情时,甲方应保证所有权人或其它影响乙方权益的第三人,能继续遵守本合同所有条款。如乙方于本合同下的权益受此等所有权人或第三者影响或损害,甲方应负责赔偿乙方的所有损失、损害、支出及费用。

五、承租人的责任

Party B shall treat the leased property with care. I f, as a result of

Party B's negligence o r misconduct, the leased property an d the related facilities suffer any damage (fair wear an d tear excepted), Party B shall be responsible fo r compensating Party A fo r such damages.

除在融资内已有的装饰和设施外,乙方如要增加设备或装修,须征得甲方的同意,甲方不得无理拒绝或延误;租赁期满必须恢复原状(正常损耗、磨损除外),并承担其费用,经甲方验收认可后归还甲方。甲方同意期满前两个月通知乙方其所需拆除的在融资内的任何改变及改进的设施。

In A ddition to the deco ration an d equipment already in the property, I f Party B wishes to make any A lterations o r improvements to the property, Party B must get Party A's consent. Any such consent shall not be unreasonably withheld o r delayed. On expiry of the tenancy, Party B must han d over the property to Party A in its o riginal condition (fair wear an d tear excepted)。 All fees arising from such wo rk to do so are to be bo rne by Party B. Party A agrees to provide Party B with two months' notice prio r to the expiry of the contract, in the event Party A requires demolition of any A lteration o r improvement carried out to the property by Party B.

若乙方、乙方雇员或任何其他经乙方许可的人员进入该融资,对甲方或其他住户造成损失,不论故意或过失,乙方皆应对造成的所有损失予以赔偿。

In case of Party B, employees of Party B o r any other person permitted by Party B to enter the property causing damages to Party A o r other tenants, whether intentionally o r negligently, Party B shall compensate fo r all the losses caused by such damages.

乙方不得携带任何违禁危险物品进入该融资,严禁从事任何违反_法律法规的活动;如因此发生损害,乙方应承担全部责任。

Party B shall not bring anything dangerous o r fo rbidden in the leased property, an d not behave against the laws o r regulations of the People's Republic of China, an d shall be fully responsible fo r any damages o r losses as a result thereof.

在本合同期满前一个月内,乙方应允许甲方或其指定的人经与乙方预约后,在合理的时间内陪同其他有兴趣租住该楼宇的人士参观

六、违约处理

Breach of Contract

甲、乙任何一方如未按本合同的条款履行,构成违约,应承担相应的违约责任,

双方同意违约方应赔偿

受害方之直接损失(间接和结果性损失除外)。甲方若有违约并在七日内未予补救,乙方则有权延付租金和管理费或做相应的扣除。

I f either Party A o r Party B fails to perfo rm its obligations hereunder, it shall constitute a breach of this Contract an d the defaulting party shall undertake the liabilities fo r such breach. The parties agree that the party in breach shall pay the other party the direct losses an d damage (excluding indirect an d consequential loss an d damages)。 I f Party A is in breach of this Contract an d does not rectI fy within 七 days, then Party B is entitled to withhold o r deduct the rental as well as management fee.

甲方有下列行为之一的,乙方有权中止本合同,甲方除应退还乙方保证金和已支付但未居住的租金外,还应支付乙方两个月的租金的金额作为赔偿。

Party B shall have the right to terminate the Contract an d have recourse to a refund of the two month's security deposit an d rental already paid together with a compensation sum equivalent to two months rental I f party A commits one of the following:

(a) 未经乙方同意,在租赁期间收回该融资。

During the lease term, take possession of the Premises without Party's B consent.

(b) 本合同开始三十天后,仍未向乙方移交该融资。

Fail to han d over the Premises to Party B within thirty days after the commencing date of the Contract.

乙方有下列行为之一的,甲方有权中止本合同,收回该房屋并且保证金不予退

Party A shall have the right to terminate this Contract, re-possess the leased property an d fo rfeit the security deposit I f Party B commits one

of the followings.

(a) 将承租的房屋擅自转租,但转租给乙方本公司人员除外。

Sublets the leased property to another person without Party A's

consent, but associated person of Party B excepted.

(b) 未得甲方同意,将承租的房屋擅自拆改结构或改变用途的。

A lters the structure of the premises without autho rization o r uses the premises other than the purpose stated herein.

(c) 无故拖欠租金超过三十天。

Fail to pay rental without any reason fo r mo re than 三零 days after the due date.

七、不可抗力

Fo rce Majeure

若由于不可抗拒的自然灾害(包括但不限于火灾、洪水、地震、施工、战争、暴动、敌队等行为等)或其它非双方过错所造成的对本融资的损毁致使其无法居住或使用本融资,双方有权中止本合同,甲方必须退还乙方所有保证金和已支付但未居住的租金。届时合同双方将不再承担进一步的任何责任。

I f the leased property is destroyed, damaged an d rendered uninhabitable an d unusable due to fo rce majeure (including but not limited to fires, flood, earthquake, accidents, strikes, wars, insurrections, public enemy etc.) o r actions that are not the result of Party A o r Party B's fault, either party has the right to terminate the Contract an d pro rated balance of al rental prepaid, as well as the deposit, shall be returned to Party B. Thereafter, the both parties shall not have any responsibilities to each other.

八、争议的解决

Dispute Resolution

凡因本合同条款、翻译、任何合同相关事宜所引起的一切争议,双方应友好协商解决;协商不成,应提交上海市仲裁委员会,按其仲裁原则和_仲裁法在上海进行仲裁,仲裁裁决是终局的,对双方都有约束力。

Any dispute o r dI fference that arise between Party A an d Party B relating to any clause, interpretation, matter o r things whatsoever herein connected with this agreement shall be settled amicably between both parties hereof. I f such negotiation fails, the parties shall submit the

dispute to arbitration by Shanghai Arbitration Commission in Shanghai acco rding to its arbitration rules. The decision of the arbitrage body is final an d shall binding on the parties hereto.

九、其它

Others

本合同附件是本合同不可分割的一部分,与本合同具有同等效力。

三. 甲方应确保出租的房屋享有出租的权利,反之如乙方权益因此遭受损害,甲方应负赔偿责任。

七、 乙方义务 obligations of party b

一. 乙方应按合同的规定按时支付定金、租金及保证金。

二. 乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。

三. 未经甲方同意,乙方不得将承租的房屋转租或分租,并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损,乙方应承担赔偿责任。

八、 合同终止及解除的规定 termination and dissolution of the contract

The eighth article: liability for breach of contract

三. Party A shall provide complete design information before the start of the design, due to Party A's provision of incomplete information and changes in content.

For structural changes, Party A shall pay the corresponding cost of design changes.

四. After Party B receives the complete design information of Party A, it is designed to facilitate the determination of the style of Party A, and Party B begins to design the first draft after the style is determined.

五, Party A has the right to put forward amendments to the works designed by Party B. The first draft Party A can make a structural modification. After the first draft is determined, the structural modifications should be made. Party A shall pay the corresponding cost separately.

Five. The agreement on intellectual property rights:

四、乙方收到甲方的完整设计资料后进行部分小样设计以方便甲方确定风格,风格确定后乙方开始进行初稿设计。

五、甲方有权对乙方所设计的作品提出修改意见,初稿甲方可提出一次结构上的修改,初稿确定后的结构修改,甲方须另行支付相应费用。

六、因甲方修改,延误时间造成的后果,由甲方承担。

七、由于后期制作造成的损失由甲方独自承担,由于制作物设计出现问题造成的损失由乙方承担。 因版权、文责所引发的法律责任,经济纠纷由甲方承担。

八、设计项目期间乙方挂靠于甲方品牌之中,不得以乙方身份单独与客户签订任何形式的合作协议。

五、知识产权约定:

一、乙方对设计完成的作品享有著作权。甲方将委托设计的所有费用结算完毕后,乙方可将作品著作权转让给甲方。

二、甲方在未付清所有委托设计费用之前,乙方设计的作品著作权归乙方,甲方对该作品不享有任何权利。

三、甲方在余款未付清之前擅自使用或者修改使用乙方设计的作品而导致的侵权,乙方有权追究其法律责任。

六、违约责任:

一、甲方在设计作品初稿完成前终止合同,其预付的费用无权要求退回;甲方在乙方作品初稿完成后终止合同的,应当支付全额的设计费用。

二、乙方如无正当理由提前终止合同,所收取的费用应当全部退回给甲方。

七、甲乙双方如因履行本合同发生纠纷,应当友好协商解决,协商不成的,甲乙双方任何一方均可向北京仲裁委员会提请仲裁解决。

八、本合同自甲乙双方签字盖章之日起生效,本合同一式两份,双方各持对方签字(盖章)合同一份,具有同等的法律效力。

九、本合同如有未尽事宜,由甲乙双方共同讨论补充或修改。补充和修改的内容与本合同具有同等效力。
